Sheriff McEathron says Roy Dwayne Fincham is not back in Warren County Jail yet, and it could be a matter of days or weeks until he is. The sheriff says it all depends on what he does tomorrow in court in Maryland.

"We're going to get him back in our house, and hopefully he will get more time for it, and he won't ever see trustee status again."

Fincham is being held in Howard County Detention Center and McEathron says they can't just bring him across state lines, they need a court order to do that, so Fincham has to go through that process.

"They found him in a Wal-Mart parking lot in a vehicle." He says it was the US Marshals service who found him.

Warren County Sheriff's Office asked them to help search for Roy Dwayne Fincham when they got the feeling he had left the state.

So what was Fincham doing at the time they caught him? "Asleep in a vehicle and we were able to apprehend him, I believe without incident"

That's not all they found, Fincham was with his girlfriend, Tanya Mccallum, who is now being charged for helping him escape.

"We knew it was just a matter of time that he was going to surface again, so it's good that it's just a short time frame."
