A 10 million dollar lawsuit filed Monday in Prince William County Circuit Court alleges that 8 different organizations, 2 of which are based locally, were at fault in the death of Stephens City youngster Hayden Barnes Ellias.
Ellias was killed last May when an unsecured portable soccer goal at Millbrook High School tipped over on him.
Among those named in the suit are Howard Shockey and Sons incorporated of Winchester, who according to the lawsuit, installed the goal at Millbrook. The suit also named the Blue Ridge Youth Soccer Association, which is run out of the Winchester area. Neither organization had any comment as of air-time Monday.
TV3 did speak with the Ellias family lawyer, who told us the family's goal is to make sure what happened to Hayden, never happens again. "Hayden was one of dozens of kids who have been killed by this type of design and the failure to properly use this goal," noted the Chicago-area attorney, who has represented other families in similar goal tip-over cases.
"The family is hopeful that in filing this lawsuit, they're going to get some real change in the soccer industry, not only in the way people use these goals, but also in how they are designed as well."
